Is there anyone whom is knowledgeable about the laws in this "F" up state of New Jersey. Im a big gun enthusiast I shot often I try to keep up on current gun laws for my personal safety and protection.Long story short I was out shoting and a guy that was there shoting also next to me observed my rifle and said the grip was illegal in nj.I looked at it and said Its stock and i bought it from a well known gun shop in nj. I have been looking for info online about grips being illegal, but can't find anything its a I.o ak47C semi auto10rd mag (anything over 15rd in a semi auto rifle is illegal ) .please help...
 
He was a off duty cop he reported it... long story short I surrendered it to the my local police dept along with a copy of the bill of sales to avoid any farther complication Its now in the gloucsteter county prosocuters office they're claiming it also illegal which is bull$hit imo.im heading to the gun shop in the morning to hopefully get the matter resolve im just at work pisssssssed looking for answers I want my gun back **** it!!
 
Will someone please define a legal or illegal grip to me.

New Jersey law lists firearms that are prohibited "assault firearms." N.J.S.A. 2C:39-1w.(1). In addition, the law provides that the term "assault firearm" includes, "Any firearm manufactured under any designation which is substantially identical to any of the firearms listed" in the law. N.J.S.A. 2C:39-1w.(2). Thus, a firearm is an assault firearm if it is included on the list of banned firearms or if it is manufactured under a different designation than a firearm on the list but is "substantially identical" to a specific listed firearm.We believe "substantially identical" is clear by its plain meaning. The Criminal Code provides that the statutes in the Code must be read "according to the fair import of their terms." N.J.S.A. 2C:1-2c. The Criminal Code explains that where language may be susceptible to different readings it must be construed to "give fair warning of the nature of the conduct proscribed." N.J.S.A. 2C:1-2a.(4), c. Simply put, the phrase "substantially identical" must be given its plain meaning, one that gives fair warning.The term "substantial" means pertaining to the substance, matter, material or essence of a thing. The term "identical" means exactly the same. Hence, a firearm is substantially identical to another only if it is identical in all material, essential respects. A firearm is not substantially identical to a listed assault firearm unless it is identical except for differences which do not alter the essential nature of the firearm.The following are examples of manufacturer changes that do not alter the essential nature of the firearm: name or designation of the firearm; the color of the firearm; the material used to make the barrel or stock of the firearm; the material used to make a pistol grip; a modification of a pistol grip. This is not an exclusive list.A semi-automatic firearm should be considered to be "substantially identical," that is, identical in all material respects, to a named assault weapon if it meets the below listed criteria:A. semi-automatic rifle that has the ability to accept a detachable magazine and has at least 2 of the following:a folding or telescoping stock;a pistol grip that protrudes conspicuously beneath the action of the weapon;a bayonet mount;a flash suppressor or threaded barrel designed to accommodate a flash suppressor; anda grenade launcher

I was refering to the pistol grip. You can only have 1 of the 2 .I have 1 the pistol grip so im good to go.Next time I will take Tims advice and just keep shoting however I shall keep a copy of this legislation and bill of sales with me when I take anything out...

This Sh-t is getting way out of hand everyone needs to keep contacting their elected persons, remember, they are elected to serve YOU, don't be afraid to bother the snot out of them, after the 2nd amendment is overridden you will have NOTHING and you will be nothing but a subject/object. then the socialistic government will totally CONTROL YOU and your family. And don't even think about trying to protect yourself for thieves/rapists/etc/etc. Because when you stab(you won't have a gun) and kill one of these predators you will be the one that get to go to jail.

People PLEASE remember your history class about the 1930's.
 
There are quite a few "grey areas" as to what each state will enforce, Some are jumping on with their own versions too.

Good idea to have your paperwork with you, Always someone out there with a cause just looking for a reason.........

After reading the"law" that Chas posted it sounded very GREY to me. Sounds like a certain law enforcement officer was trying to make a few "Brownie" points with his boss.
 
I've already been intouch with my lawyer it a b.s. accusation.The legislation is a documents that only attorneys and poloticians understand . I need only concern myself with is that my semi automatic rifle is a "substantially identical" firearm thats getting returned to its owner ;-) .That prosecutor or cop will not be getting a promotion off my back side !!

Anyone who has a similar issues should consult they're lawyer and review they're state police web site as I was directed too,stay informed know your rights!!!

This sh*t really upsets me. A lot of my family has served for this country. My hat is off to everyone that has. And for now what for some a hole that took an oath to follow the constitution when sworn in. To destroy our second amendment now.

I'm sorry but if anyone ever says anything at a gun range to me about my guns. I'll tell them to mind thier own **** business. I don't care who the hell they are... Glad I also have private property to shoot on!

Happy for you to get your gun back. That officer should get punished for opening thier big ignorant mouth....
