Cant sell certain decals any more

I can't sell any more Dewelt (misspelled on purpose) decals to the "public". Apparently their attorneys cant find anything better to do than to go after little mom and pop businesses. They bought a set of decals then sent me a registered letter demanding $22000. and all my pictures of the boat that had their "copyrighted" logo on them. I'm sending them a letter with all my pics of my son holding his boat and trophy from the races as well as all of my Dewelt tools in lou of payment kuz I sure as heck don't want em any more!

ps If you respond to this post do not spell out their name. I'm sure they found my web site by googling their name.

UPS did the same thing when they changed there logo
They made us pull there name off the old U6 display boat in 2002. They did not want there name tied to boat racing!!I have not liked the yellow and Black since. I can also say the Kellogies almost the same thing and had the security Escort the team from there grounds. Some things alot of people do not Know. Doug

Wes, large companies like Tamiya, Kyosho are paying lots of money for using models, decals etc since they are registrated brands. Some companies are making copies of cars, planes or boats without paying to the real ones BUT they often change the model a bit:. NO! it s a Nanoracer since they don't use the registrated name McLaren although it looks like it.

Here is another example: Sony is a registrated name and makes in ear earphones in a wide variety of price ranges. Here are the original ones: the MDR ex700 earphones. Original: http://www.amazon.com/Sony-Mdr-Ex700Lp-Ear...1982&sr=8-1 and from China: http://cgi.ebay.com/MDR-EX700-EARBUD-HEADP...93%3A1|294%3A50 (I didn't knew shenzen was in USA :D ) They look like the original ones but they are 100% fake! Now DeW(a)lt is large company who sells their products worldwide through authorized dealers and I can imagine they would protect their name so do you. IT differs from company to company: some see it as a thread and other sees it as "free"advertisement. How many boaters have build a Miss Budweiser or an O Boy Oberto hydro without having trouble?

This is nothing new. Companies get very protective of their logos. We as modelers take a very lax attitude about it and think that they will be happy with the "free" advertising. Not so. I just bought a Thunderboat with Harley Davidson all over it. I will try not to make a big deal out of it because I know they are a company that likes to protect their log as well.

Bottom line is we have absolutely no right to use the logo of any company without prior permission. They get very picky when you are doing it to make money, less so when it s for personal use. People can argue about this all they want, but I have been around this issue for a long time and I can tell you that it very rarely goes in the favor of the modeler.

How about this, there was a guy a few years back making small RC gliders of various warbirds. The P-38 was one of them. Lockheed heard about him and put the strongarm to him. He ended up paying a $250 fee for one year, then the next year they came back and wanted $25,000. He sold these planes for $100 and sold about 75 or so per year. I have endless stories like this.

Like I said, the simple fact is despite how much we think it is wrong, we simply cannot use any legally protected logo, etc. without prior permission, and especially so if you are making money off it (the amount is irrelevant).

Bill you are partially correct. I've already been through this. It cost me a little money for a snake lawyer but I won. But unfortunately this is one of the reasons that I stopped to doing boat graphics. I had a similar issue but not with the same company you are dealing with Wes. You do have some protection, I suggest you consult an attorney if you want to get them off your back legally. The company you are dealing with has some holes in their argument even though it is a registered trademark. Their logos are sold and licensed in certain logo libraries available to graphics and sign shops all over the country so they don't have as much teeth in their claim as they think. I'm sure you have one of them. I had 4 and all of them had their logos. All but 1 required a licensing agreement. Besides they are going to have a hard time convincing a judge you are doing $22,000 in harm to their business.

Besides if it is your boat you also have some protection but they can file a cease a desist claim to keep you from selling those decals to others. Technically they could come after you if you did a sign for a tool distributor that was an authorized dealer. I've been all over this issue on a number of levels and it was expensive. Talk to a lawyer.
 
I really dislike hearing stuff like that, but I'm glad you made me aware of it because I now know which brand NOT to consider when buying power tools........ no matter how good they might or might not be. I'm sure there are others out there thinking exactly the same thing.

Just "Googled" dewalt. They are going to have to sue a lot of people. Found site after site that had it for download.

Agreed. I buy tools every week (auto mechanic) and while they sell a decent tool, they don't sell anything I couldn't live without. Large companies should remember who buys thier products.

I too will not purchase from them. I currently am in the market for a good cordless drill. It will not be a big D
 
over priced black and decker garbage as far as im concerned. i have sold tools for a long time. always have a customer say "i need to replace my broken drill" 2/3 of the time it was a dewalt he or she was replacing. MAKITA the only power tool to buy. performance and reliabilty!!! hang in there wes. i agree get a lawyer. they dont have a leg to stand on!!!!!!!!!
 
Unfortunately I use one 1/2" drill that is dewalt, happens to be the better design for drillin' big holes in new homes,

many plumbing contractors use them. Drill was originally a B&D "Timber Wolf" I believe,, if there was an equal,

I'd drop that mutha in a hot second.

As some of you know, my sister has a laser cutting business. With her cutters comes some program discs that are very expensive that contain logos from a lot of major companies including Futaba, Hi-tec and Airtronics on the files. The reason why she had to pay the big bucks was because of them using brand names.

Anyone remember Autographics? They got into hot water for using Miller beer decals and had to change Goodwrench to Goodwreck but included the extra lettering so that it could be changed. Bud, the same problem. People wanting to use the Miss Budweiser logo's or anything related to Anhueser-Busch paid a royalty that went towards charities.

Next was a big controversy involving model planes, R/C or static, it didn't matter. Some AMA members might remember this as it only happened a couple of years ago. The full-sized airplane makers wanted money from anyone making model kits of any US plane. Fortunately as far as I know, that faded quickly into the sunset. If I were in that position as a model maker, I'd tell them where to shove it then only make kits of only Japanese, British, German or Soviet-made planes.

It was having some DeWalt decals made for my Sport .12 but I think that they'll just collect dust.

If this type of thing keeps up, there will be a lot of 1/8 scale "The Boat" hydro's racing.

I built a new deck with my Makita 9.6volt. I fell into the pool with the drill, all the way to the bottom. I let it sit in the sun for about an hour and started using it again. It is still my drill I use today. Maybe I'll make my sport 20 a Makita boat.

Man, I am sorry to hear that!! I will preach no Dewalt from now on. I went and looked at the RC Boat Company site. I noticed exactly what I expected. All forms of Dewalt are gone from the site. No pics or mention of that boat now. It used to be on there quite prominently. He may have gotten the same letter. Ken

Fearing somrthing stupid like this could happen,when i built my RedMan Scale i contacted the parent company and even sent photos after it was done. No problems as o had the decals made and showed proof to the decal maker so he would not worry about a problem. Looks like you better sell decals to known boaters,if the aholes would come to a race they would understand.......
 
Sorry to here that Wes what a crock. I sent this to the president of the company that I work for, we are a nation wide construction company with over 1000 employees and he has emailed the entire company to ban the buying of DeWalt tools. He also owns a directional boring company that will adopt the same policy. This is only 2 companies but with a little help things like this could defiantly hurt this tool company.
